Leak of Secret Trade Document Reveals Sovereignty-Destroying Courts

Why has the Obama administration kept the Trans-Pacific Partnership agreement text secret from Congress and the American people? 

A newly leaked TPP chapter reveals at least one huge reason: The TPP text proposes creating tribunals (courts) that could overrule the decisions of our state and federal courts, as well as our local, state and federal laws — and our state and national constitutions.

The tribunals would be presided over by arbitrators (judges) appointed by the Secretary-General of the International Centre for Settlement of Investment Disputes (ICSID), an institution of the World Bank Group. The ICSID is housed at the World Bank’s headquarters complex in Washington, D.C. The ICSID receives its funding from the World Bank and the ICSID’s governing Council is chaired by the President of the World Bank. So the proposed TPP tribunals are, in essence, a means for transferring judicial authority over vast areas of domestic law to “arbitrators” picked by the World Bank — and the central bankers and the giant commercial/investment bankers that run the World Bank.

On March 25, the international organization WikiLeaks released the “Investment Chapter” of the still-classified Trans-Pacific Partnership agreement that the Obama administration has been secretly negotiating for the past several years. Despite repeated calls from members of the United States Senate and House of Representatives, as well as legal scholars and law professors for the administration to make good on its pledges of transparency, the TPP negotiations have remained a closed, secret  process — except for the representatives of major corporations and Wall Street banks, along with other privileged “stakeholders,” who are not only given access to the TPP documents, but even allowed to participate in negotiations.

The WikiLeaks release of the TPP’s Chapter 2 on investment should assist patriots who are trying to build opposition to this dangerous agreement that represents a giant step toward regional and global government. It also confirms what The New American has reported over the past several years: that TPP was following in the footsteps of NAFTA, the WTO and other “free trade” arrangements that are rapidly eroding U.S. national sovereignty and independence.

Among the significant articles included in Chapter 2 is “Article II.21: Selection of Arbitrators.” This section tells us, among other things: “The Secretary-General [of ICSID] shall serve as appointing authority for an arbitration under this Section.” It states further: “if a tribunal has not been constituted within 75 days from the date that a claim is submitted to arbitration under this Section, the Secretary-General, on the request of a disputing party, shall appoint, in his or her discretion, the arbitrators not yet appointed.”

As we have noted in previous articles, Secretary of State John Kerry has been a key operative in overseeing the TPP negotiations. While he was a U.S. Senator, Kerry supported and voted for NAFTA. Years later, when NAFTA tribunals began overruling U.S. law and U.S. court decisions, Kerry used the innocence-through-ignorance defense, claiming to have been completely blindsided by the Chapter 11 tribunals that were in the agreement he voted for. 

"When we debated NAFTA," Kerry told the New York Times, "not a single word was uttered in discussing Chapter 11. Why? Because we didn't know how this provision would play out. No one really knew just how high the stakes would get." But it is not true that “no one really knew” of the danger from the tribunals; this publication, along with others warned of this very danger. But Senator Kerry and other NAFTA supporters chose to ignore, or scoff at, those warnings. Moreover, it was his duty to know what was in the agreement before voting for it; the claim of ignorance is a self-incriminating excuse.

In its unauthorized release of the purported TPP text on March 25, Wikileaks provides this description:

This is an advanced January 2015 version of the confidential draft treaty chapter from the Investment groups of the Trans Pacific Partnership (TPP) talks between the United States, Mexico, Canada, Australia, Malaysia, Singapore, Peru, Vietnam, New Zealand and Brunei Darussalam. The treaty is being negotiated in secret by delegations from each of these 12 countries, who together account for 40% of global GDP. The chapter covers agreements on investments from one TPP nation to another, including empowering foreign firms to “sue” other states’ governments, as well as regulations around investor-state dispute settlements and tribunals. This document was prepared by TPP investment chapter negotiators in advance of the informal round of negotiations held in New York City 26th January to 1st February, 2015.

The WikiLeaks release also highlights another audacious feature of the TPP that we have reported previously: not only are the negotiations being conducted in secrecy, and not only are the TPP text documents being withheld from the public and the public’s elected representatives, but even more outrageous is the effort by the TPP negotiators to keep the agreement (or at least certain portions of the agreement and the negotiating process) secret for four years after it goes into effect! The biggest threat to Canada’s national security is internal. It is the offshoot of an extraordinarily successful—because it remains largely undetected—coup that imposed itself on the country with the federal election of the Conservative Party of Canada (CPC) in 2006, and solidified its impacts with the election of a Conservative majority in 2011.

Author, poet, academic, and former Canadian diplomat Prof. Peter Dale Scott recently disclosed a WikiLeaks cable indicating that the International Republican Institute (IRI), an off-shoot of the CIA, and a subsidiary of the National Endowment for Democracy (NED) helped install Stephen Harper as Canada’s Prime Minister. This was the coup.

Point 12 of the cable explains that “In addition to the campaign schools, IRI will be bringing in consultants who specialize in party renovation to discuss case studies of political parties in Germany, Spain, and Canada which successfully carried out the process.”

The “party renovation” referenced in the cable is the “renovation” of Canada’s indigenous Progressive Conservative Party into a Republican-inspired Conservative Party of Canada (CPC) that is largely subservient to the U.S Empire south of the border.

A similar, but more violent, “renovation” process occurred in 2009 when the democratically-elected government of Manuel Zelaya was overthrown in a U.S-orchestrated coup. It is also the same illegal “renovation” that is destabilizing Venezuela today, as the US interferes in the internal politics of that country, in what is often described as a “soft coup”.

Dr. Anthony James Hall, Professor of Globalization Studies at the University of Lethbridge, Alberta Canada, explains the genesis of the Harper Conservative assault on the “Red Tory” traditions of Canada’s indigenous conservative party in Flanagan’s Last Stand? :
” The assault by the Harper-Flanagan juggernaut on the generally friendly orientation of Canadian conservatism towards the state, towards Indigenous peoples, and towards the institutions of Crown sovereignty helped clear aside obstacles to the importation from United States of the Republican Party’s jihad on managed capitalism. Flanagan and Harper took charge of the Canadian version of the Reagan Revolution aimed at transforming the social welfare state into the stock market state.”

The implications of this conservative “jihad” are a threat to our national security on many levels. Stephen Harper’s attacks on Canada’s knowledge base are foundational to what can only be described as an endorsement of man-made climate change, which is likely the foremost threat to both humanity and to Canada. The Fifth Assessment Report of the International Panel on Climate Change (IPCC) stresses the urgency to act now to mitigate catastrophic climate change, and yet the Harper government is moving Canada in the opposite direction. Most recently, the Harper government ratified a bilateral agreement with China, the Foreign Investment Promotion and Protection Agreement (FIPPA), which all but guarantees further expansion of Canada’s Tar Sands, and an expansion of its carbon economy.

Canada’s warmongering also bodes poorly for our collective security. The Conservative government has exploited the collective shock of the murder of Corporal Cirillo at Ottawa’s National War Monument, and the subsequent shoot-out at the House of Commons, by falsely conflating the tragedy with “Islamic terrorism” and by using it as a pretext to wage illegal warfare against ISIS. Many Canadians, including Cpl. Nathan Cirillo’s girlfriend, argue that we should be addressing the tragedy by improving Canada’s capacity to provide mental health care for all of its citizens, yet that is not part of the Harper government’s longstanding agenda.

Instead of working to stop the flow of money and arms to proxy mercenary armies—that are for the most part allied with the West to illegally topple the government of Syria’s Bashar al-Assad—Canada has instead chosen to use military options, all but guaranteeing prolonged and deadly warfare which will exact a horrendous toll on innocent civilians.

This militarism will likely be a threat to Canada’s security as well, since Canada will increasingly be associated with war crimes and imperial hegemony abroad, rather than peace-keeping.

The largely undetected coup, as revealed by the WikiLeaks cable, goes a long way towards explaining Canada’s current predicament. 

This secret intervention in Canada’s political landscape will continue to undermine our country’s prosperity and security, unless we become more conscious of its insidious impacts and choose instead trajectories towards peace and national security. The foundational (though suppressed) evidence is shouting that we’re on the wrong course, and that we need to make changes fast.

CIA rendition jet was waiting in Europe to SNATCH SNOWDEN

As the whistleblowing NSA sysadmin Edward Snowden made his dramatic escape to Russia a year ago, a secret US government jet - previously employed in CIA "rendition" flights on which terror suspects disappeared into invisible "black" imprisonment - flew into Europe in a bid to spirit him back to America, the Register can reveal.

On the evening of 24 June 2013, as Snowden arrived in Moscow from Hong Kong intending to fly on to Cuba, an unmarked Gulfstream V business jet - tail number N977GA - took off from a quiet commercial airport 30 miles from Washington DC. Manassas Regional Airport discreetly offers its clients "the personal accommodations and amenities you can't find at commercial airports".

Early next morning, N977GA was detected heading east over Scotland at the unusually high altitude of 45,000 feet. It had not filed a flight plan, and was flying above the level at which air traffic control reporting is mandatory.

"The plane showed up on our system at 5:20 on 25 June," according to our source, a member of an internet aircraft-tracking network run by enthusiasts in the UK. "We knew the reputation of this aircraft and what it had done in the past."

N977GA was not reporting its progress to air-traffic controllers, and thus it would normally have been necessary to use a massive commercial or military radar installation to follow its path. But, even if pilots have turned off automated location data feeds, ordinary enthusiasts equipped with nothing more than suitable radio receivers connected to the internet can measure differences in the time at which an aircraft's radar transponder signal reaches locations on the ground. Using the technique of multilateration, this information is sufficient to calculate the transponder's position and so track the aircraft. (The ACMS/ACARS data feeds which automatically report an aircraft's position are a separate system from the transponder which responds to air-traffic radar pulses. They too can be picked up by receivers on the ground beneath, if they are activated.)

Several such online tracking networks are active in the UK, using this and other sources of information: they include www.flightradar24.com, www.planefinder.net, Planeplotter (www.coaa.co.uk/planeplotter.htm) and www.radarvirtuel.com. UK-based Planeplotter is one of the more sophisticated of these global "virtual radar" systems. It boasts 2,000 members with receivers hooked up to the internet.

The online tracking information reveals that the Gulfstream did not make it all the way to Moscow, but set down and waited at Copenhagen Airport.

At the time, Washington was demanding that Moscow should hand over the fleeing Snowden into US custody.

"We expect the Russian government to look at all options available to expel Mr Snowden back to the US to face justice for the crimes with which he is charged," a National Security Council spokeswoman told reporters. The US also urged countries in the "Western Hemisphere" not to let him in.

The black jet is actually white.

The Kremlin's response, however, was a big "nyet". Russia's Interfax News quoted government sources as saying:

"Snowden has not committed any crimes on Russian territory ... Russian law-enforcement agencies have received no instructions through Interpol to detain him. So we have no grounds."

N977GA has a chequered history. It was originally ordered by the US Air Force for use as a general's flying gin-palace. But then, shortly after 9/11, it lost its military livery and acquired civilian registration as N596GA. Under that designation it was employed in CIA "renditions" - or kidnappings. In 2011, the "black" jet switched roles again, transferring from the CIA's contractor to use instead by the Department of Justice (DoJ).

With its new tail number N977GA the plane became part of the Justice Prisoner and Alien Transportation Systems (JPATS), operated by US Marshals. On perhaps its best-known mission, the jet flew a team of marshals into the UK on 5 October 2012 to collect radical cleric Abu Hamza after the USA won an extradition order against him.

Only Vladimir Putin's intransigence saved Snowden from a similar travel package, complete with free one-way ticket home and fitting for a stylish new orange outfit. Abu Hamza was last seen waving goodbye from a back window on N977GA.

According to Mr Snowden's colleagues, if the Russians knew that an American team was on its way to bring him home, they did not warn him. In the event the "black" (actually white) Gulfstream and its posse of marshals got no further than Copenhagen as US negotiations with the Kremlin failed to prosper. But Snowden remains in Russia to this day - and potentially for the rest of his life.

The US Department of Justice did not respond to our requests for information regarding N977GA and its purpose in heading to Europe on 24 June last year. ®

NSA Spying: Conspiracy of the English-Speaking Nations - Revelation by Snowden

The recent revelations which have come from the Edward Snowden NSA spying material point directly at a conspiracy being waged by the major English-speaking powers of the world. Each of these four nations has been purposefully exempted from the most intensive surveillance regime ever imposed on the community of nations.


Therefore, one is compelled to ask:


Why do only these four English-speaking countries of the world receive such special treatment by the world's military and surveillance superpower — the USA?

Australia

New Zealand

That 193 other nations have become the victims of NSA spying, yet these English-speaking nations have not "speaks" volumes about the real plot that has been afoot for centuries to subjugate the entire planetary civilization. This global conspiracy first took form under the rubric of the British Empire. Since the perceived diminution of the British Empire, it has simply transformed into a multi-faceted global management scheme managed from the City of London, the financial capital of the world. Of course the military enforcement regime, which has been fastidiously put into place since the beginning of the 20th century, has been administered out of Washington, DC.

All but four nations are subject to NSA surveillance – new Snowden leak

Previously undisclosed files leaked to the media by former intelligence contractor Edward Snowden now show that the United States National Security Agency has been authorized to spy on persons in all but four countries.

The Washington Post published on Monday official documents provided by Mr. Snowden that shows new proof concerning the extent of the NSA's vast surveillance apparatus.

One of the documents—a file marked "top secret" from 2010 and approved by the US Foreign Intelligence Surveillance Court—shows that the NSA has been authorized to conduct surveillance on 193 foreign government, as well as various factions and organizations around the world, including the International Monetary Fund, the European Union and the International Atomic Energy Agency.

 "Virtually no foreign government is off-limits for the National Security Agency, which has been authorized to intercept information from individuals 'concerning' all but four countries on Earth, according to top-secret documents," journalists Ellen Nakashima and Barton Gellman wrote for the Post.

The reporters write that the NSA's ability to target the communications of foreign persons and parties is "far more elastic" than previously known, and that documents suggest the agency can acquire conversations that may not involve an intelligence target directly, but concern that individual or entity to a certain degree by relying on provisions contained within the Foreign Intelligence Surveillance Act.

Unless, of course, that person of interest is a citizen of one of the 'Five Eyes' nations that, together with the US, are involved in a global surveillance partnership of sorts.

According to the Post, the NSA's computers automatically filter out phone calls from Britain, Canada, Australia and New Zealand that would otherwise be collected using FISA. Even those nations, however, aren't entirely sparred.
Nakashima and Gellman go on to acknowledge that the list contains 28 sovereign territories, including the British Virgin Islands, where the NSA reportedly still does permit intelligence gathering filtering out those country codes would otherwise slow the system down.

One former senior defense official who spoke to the journalists on condition of anonymity said that the broad authority is allowed so that the US government is able to assess any developing situations around the world at the drop of a hat.

"It's not impossible to imagine a humanitarian crisis in a country that's friendly to the United States, where the military might be expected on a moment's notice to go in and evacuate all Americans," the official said. "If that certification did not list the country," the source suggested, then the NSA could not gather intelligence under the FISA Amendments Act, which allows for the interception of such communications.

"These documents show both the potential scope of the government's surveillance activities and the exceedingly modest role the court plays in overseeing them," Jameel Jaffer, deputy legal director for the American Civil Liberties Union, told the Post.[1]

Conclusion:

The community of nations has an obligation to investigate and prosecute this widespread, ongoing and dangerous breach of international law. Not to do so leaves the whole world in a very precarious situation. The longer that this predicament is allowed to persist, the more difficult it will be to extricate the global community from such a planetary surveillance octopus.

Members of Germany’s parliament are still smarting over last year’s revelations that the U.S. National Security Agency (NSA) spied on German citizens—including the phone calls of Chancellor Angela Merkel. The German leader, once publicly upset herself over the news, has chosen to mend ties with Washington, which would explain a confrontation between Merkel and lawmakers.

Members of parliament intent on learning more about the NSA surveillance have said they want whistleblower Edward Snowden, whose leaks exposed the spying on Germany and other U.S. allies, to testify before a special committee investigating the issue. Merkel’s government, however, is aghast at the idea of Snowden’s testimony, fearing it would only stir more trouble for the German-American alliance.

Officials have expressed their displeasure to the lawmakers, who refused to back down on their request to have Snowden appear before the committee—either in person or  perhaps by videoconferencing, as he exiled himself to Russia and risks being arrested if he steps foot in any U.S. allied nation.

Merkel’s government upped the stakes in the standoff and hired a Washington-based law firm to threaten lawmakers if they take Snowden’s testimony.

A letter from attorney Jeffrey Harris of Rubin, Winston, Diercks, Harris & Cooke warned: “We are of the opinion that if Snowden provides classified information or documents to the Bundestag or to German diplomats who interview Snowden, such acts give rise to criminal exposure under the laws of the United States. The United States would have jurisdiction to prosecute these acts regardless of where they occur. The fact that German legislators have immunity under German laws would not shield them from prosecution in the United States.”

Techdirt opined that the threat probably won’t sit well with German lawmakers:

“This should be deeply offensive to pretty much everyone in the German government—even if the letter was apparently commissioned by the German government. The idea that they might face criminal prosecution for the simple act of investigating how the U.S. spied on the German government is insulting in the extreme.”

Snowden’s American lawyer Ben Wizner told Der Spiegel that such a conclusion—that U.S. officials might try to hold German politicians criminally liable—is “beyond absurd.” In addition, he said, Snowden “didn't offer to reveal as a witness new surveillance activities that have not been disclosed yet by journalists.”

The newest round of Trans-Pacific Partnership (TPP) negotiations begin today in Salt Lake City, Utah, where trade representatives will work towards finalizing the text of this sprawling secret agreement. Last week's publication of the controversial "Intellectual Property" chapter by Wikileaks confirmed our worst fears: the TPP carries draconian copyright enforcement provisions that threaten users' rights and could stifle innovation well into the 21st Century. 

Public opposition to the TPP continues to grow as a result of the leaked document; an opaque policymaking process that seems geared towards appeasing Big Content does not provide much in the way of legitimacy.

In the past week, 23 Republicans and 151 Democrats in the House of Representatives wrote letters to the Obama administration indicating their unwillingness to comply with the Executive's request for power to fast-track trade agreements through Congress. Fast-track authority, also known as Trade Promotion Authority, limits congressional approval over trade agreements to a yes or no, up or down vote. If a bill granting fast-track were to pass, hearings would become extremely limited, and lawmakers would have no ability to make amendments. It would give the Obama administration unchecked power to shape TPP and other agreements like the EU-U.S. trade deal, the Transatlantic Trade and Investment Partnership (T-TIP).

There are some Congress members who are actively pushing for fast-track and are vowing to introduce legislation to enact it by 2014. Thankfully, these letters from the House show the White House is going to have difficulty in finding support in Congress to pass such a bill. Still, the Obama administration is going to push hard for the passage of fast-track. The U.S. trade office is negotiating TPP as if it already has fast-track authority, by deciding for itself which countries to negotiate with and what issues are on the table.

Without fast-track, it's inconceivable that the TPP would survive congressional debate. And that's the point of all of this secrecy: the TPP's myriad harmful provisions for users wouldn't survive the sunlight of transparency, so it's being negotiated in the dark. And since negotiators only get to hear corporations' concerns while drafting these policies, it only makes sense that its agenda would exclude users' interests.

So we need to demand that our lawmakers oppose fast-track. Let's ask them to call for a hearing and exercise their authority to oversee the U.S. trade office’s secret copyright agenda.
